East Sussex County Council has started a judicial review over the government's decision to move Peacehaven, Telscombe Cliffs and East Saltdean into an expanded Brighton and Hove, according to a report by Brighton and Hove News on 12 October. The council says it has applied on a protective basis to stay within a legal time limit while the government carries out a review of the plan.
The move, confirmed by ministers in July, is not happening for now. The government paused it on 7 September, and East Sussex says residents of the three areas stay in East Sussex until further notice. Lewes District Council has also taken protective legal action. This article sets out what is confirmed, what is not, and how the plan reached this point.

What has been reported
Brighton and Hove News reports that East Sussex County Council has started a judicial review, which is a court challenge to a government decision. The decision in question is the Secretary of State's ruling on local government reorganisation.
- The council says the application was made "on a protective basis" to protect its position under a legal time limit.
- It is asking for proceedings to be paused until the government review ends.
- It will then decide what to do next.
- The aim is to stop Brighton and Hove City Council taking over East Saltdean, Telscombe Cliffs and Peacehaven.
The report does not name the court, give a case number or say when the papers were lodged.
What East Sussex has said before
The county council has opposed the move since the consultation stage. Its leader, Councillor Andy Woolley of Reform UK, said in official council statements:
If we are serious about local democracy, then local voices must count.
We will be asking Ministers to urgently reconsider.
We hope the Secretary of State will permanently think again.

In June the council also said it "strongly disagreed" with moving 23,900 residents of Peacehaven, Telscombe, East Saltdean and Falmer, and estimated implementation costs could rise by around £3.25 million. It said that figure was based on limited information.
How the plan reached this point
We covered the July decision when it was announced: Brighton and Hove to Expand: Peacehaven, Telscombe Cliffs and East Saltdean to Join the City.
What the plan would do
The government consultation page said Brighton and Hove City Council asked for the change after the first consultation. It would move four wards and one parish from Lewes district into the city. The government's July statement said the change would "expand Brighton and Hove's planning footprint and tax base to tackle housing unaffordability".
The new councils were due to start on 1 April 2028, with elections to a shadow authority in May 2027, according to East Sussex County Council. The population figures above are the ones given on the government consultation page.
Where the councils stand
The main councils involved have said the following in public statements.
Councillor Sankey's statement is as reproduced by Peacehaven Town Council.
Other councils are doing the same
Sussex is not alone. Local Government Lawyer reported on 6 October that other councils had also taken steps to protect their legal position:
- Lancashire County Council took precautionary steps.
- Amber Valley Borough Council in Derbyshire sent a pre-action protocol letter.
- Five district and borough councils in Leicestershire sent a pre-action protocol letter.
Sussex Online News reported on 7 September that at least eight councils across the country had started or were considering legal challenges.
What it means for residents now
Nothing changes day to day. East Sussex County Council says all services continue as normal, and that residents of East Saltdean, Peacehaven and Telscombe stay in East Sussex until further notice. It also says borough and district elections planned for 2027 will go ahead as originally scheduled.
Angela Rayner said the review would take "weeks rather than months", according to Sussex Online News. The government has not yet set out how local people can take part.
What we do not know yet
Several important details have not been published, or we could not find them:
- which court the application was made to, and when
- a statement from East Sussex County Council about the judicial review on its own news page
- what the government's review will decide, and when
- whether the boundary change will go ahead, change or be dropped
- how Brighton and Hove City Council will respond to the legal step
ImJustBrighton has not seen the court papers. The legal step is reported by Brighton and Hove News, and the rest comes from government and council statements.
